These Terms of Use (“Terms”) govern your access to and use of Luxo (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. WHO MAY USE LUXO

You may use Luxo only if:
- You are at least 16 years old (or the age of digital consent in your country), and
- You have the legal authority to enter into a binding agreement.

If you are using Luxo on behalf of a company, you represent that you are authorized to accept these Terms on its behalf.

2. YOUR ACCOUNT

You are responsible for:
- Maintaining the security of your account and password
- All activity that occurs under your account

If you suspect unauthorized use, you must contact us immediately.

We may suspend or terminate your account if we reasonably believe you have violated these Terms or are using the Service in a way that risks harm to us, other users, or third parties.

3. CREDITS, SUBSCRIPTIONS, AND PRICING

Luxo uses a credit-based system for image generation.

- 1 image credit = 1 image generation.
- Credits may be included in a monthly subscription or purchased separately.
- Credits do not expire and can roll over from previous months as long as your account remains active.
- Our pricing and credit models may change over time, especially as we add new models and features. We will communicate material pricing changes in advance where required (for example, by email or in-app notice).

You are responsible for all charges associated with your account. Payment processing is handled by Polar.sh and their partners; their terms and privacy practices apply to the payment step.

4. OWNERSHIP OF PROMPTS AND GENERATED IMAGES

4.1 Your ownership

As between you and us, you own the images generated in your account, to the extent permitted by applicable law.

You also retain any rights you have in your prompts and other content you submit to the Service.

4.2 Our limited rights

We do not claim any rights to use your images for our own marketing or training.

We only process and temporarily store your prompts, settings, and generated images as necessary to:

- Operate the Service
- Display your history
- Provide support
- Comply with legal obligations

We do not use your content to train our own models.

5. COMMERCIAL USE

Subject to these Terms and applicable law:
- You may generally use generated images commercially, including in apps, websites, marketing materials, and products.
- You are solely responsible for ensuring that your use of any generated image complies with all applicable laws and third-party rights (for example, privacy, publicity, and intellectual property).

Because AI models may produce outputs similar to existing works or well-known brands, we cannot guarantee that any image is unique or free from third-party rights.

You must not rely on Luxo to generate or reproduce:
- Protected logos, trademarks, or copyrighted characters
- Images of real people without their consent
- Content that violates others’ rights

6. PROHIBITED CONTENT AND USE

You agree not to use Luxo to create, upload, or share content that:

- Violates any law or regulation
- Infringes any copyright, trademark, or other intellectual property rights
- Depicts or promotes sexual content involving minors, non-consensual acts, or other abusive material
- Promotes violence, self-harm, terrorism, or hate against individuals or groups
- Violates OpenAI’s safety and content policies
- Attempts to bypass safety systems or generate content that you know will be blocked

Luxo relies on OpenAI’s models and safety systems. Some prompts may be blocked or modified automatically to comply with their policies and applicable law.

7. MODEL BEHAVIOR AND LIMITATIONS

Luxo is built on AI models that can:
- Make mistakes
- Produce unexpected or low-quality results
- Generate similar or overlapping images for different users

We do not guarantee that:
- Any particular prompt will generate a result
- The output will meet your expectations
- Outputs will be unique or free of third-party rights

You use the generated images at your own risk and should perform your own checks (for example, for trademark conflicts) where your use case is sensitive.

8. THIRD-PARTY SERVICES

Luxo integrates services operated by third parties, including:
- OpenAI (image generation)
- Supabase (databases and storage)
- Polar.sh (billing and payments)
- Resend (email delivery)

Your use of these third-party services may be governed by their own terms and policies. We are not responsible for third-party services, even when accessed through Luxo.

9. TERMINATION

You can stop using Luxo at any time and may request deletion of your account.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe:

- You have violated these Terms or applicable law
- Your use risks harm to the Service, other users, or third parties
- We are required to do so by law or by a service provider (for example, OpenAI)

Upon termination:
- Your right to use the Service ends
- We may delete or anonymize your data in line with our Privacy Policy, subject to legal retention obligations

10. DISCLAIMERS

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that generated images will be suitable for your specific use.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill.
- Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid to us in the 3 months preceding the event giving rise to the claim, or (b) EUR 50.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so (for example, for fraud or intentional misconduct).

12. CHANGES TO THE SERVICE AND TO THESE TERMS

We may update the Service and these Terms from time to time. If we make material changes to the Terms, we will notify you (for example by email or in-app notice).

Continued use of the Service after changes become effective means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.

13. GOVERNING LAW

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. If any dispute arises, you agree to submit to the exclusive jurisdiction of the competent courts in the Netherlands, unless mandatory law provides otherwise.
